What is alimony?
Alimony is a type of payment that can be made monthly or yearly that one ex-spouse pays to the other. In a few cases, alimony may be awarded in one lump sum payment.
If the alimony is paid monthly or yearly, it will normally end if the spouse receiving the alimony dies or remarries. It is designed to support the person who receives it.
Alimony is one of the main reasons that a fault divorce lawsuit is filed. When the court decides that the failure of the marriage is due to the actions of the spouse who caused the divorce, the person who caused the failure of the marriage will not be granted alimony.
My ex-spouse is not paying the court ordered alimony. What can I do?
If your spouse is not paying the alimony the court ordered them to, the court can force that spouse into garnishment. This means that a portion of their income that should go to alimony will be taken out of their paycheck before they receive it and sent to you.
